Terms of Service

These Terms of Service ("Terms") govern your use of the Eventiere platform, including the organiser portal at app.eventiere.com, the guest photo delivery experience and the marketing website at eventiere.com. By accessing or using Eventiere, you agree to be bound by these Terms.

Please read these Terms carefully. If you do not agree, do not use our services.

1. Definitions

• "Eventiere" refers to the company operating the Eventiere platform.
• "Organiser" means any individual or entity that creates an account to host events on the platform.
• "Guest" means any person who accesses an event gallery or submits a selfie to retrieve photos.
• "Content" means photographs, images, videos and any other material uploaded to the platform.
• "Services" means the AI photo matching, distribution and delivery features provided by Eventiere.

2. Eligibility

You must be at least 18 years of age to create an organiser account. By registering, you confirm that all information you provide is accurate and that you have the legal authority to bind any organisation on whose behalf you are acting.

Guests must be at least 16 years of age to submit biometric data (selfie). For events involving guests under 16 (e.g. school graduations), organisers are solely responsible for obtaining appropriate parental or guardian consent before uploading photographs of minors.

3. Organiser Accounts

As an organiser, you are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity that occurs under your account.
• Ensuring that event photographs you upload do not infringe third-party intellectual property rights.
• Obtaining appropriate consents from event guests before enabling facial recognition features, in compliance with applicable data protection law (including GDPR, UK GDPR and relevant GCC frameworks).
• Displaying appropriate privacy notices at your event (e.g. signage notifying guests that AI photo matching is in use).

Eventiere provides GDPR-compliant consent templates and signage guidance. Use of these templates does not relieve organisers of their independent obligations as data controllers for their own events.

4. Acceptable Use

You agree not to use Eventiere to:

• Upload photographs that are illegal, defamatory, pornographic, or that violate any third party's rights.
• Process biometric data of individuals who have not given explicit consent.
• Attempt to identify individuals for purposes beyond photo retrieval (e.g. surveillance, profiling, or law enforcement).
• Reverse-engineer, scrape, or otherwise extract data from the platform in bulk.
• Circumvent any security, access control, or rate-limiting measures.
• Upload malicious code or interfere with platform infrastructure.
• Resell or sublicense access to the platform without written agreement.

Eventiere reserves the right to suspend or terminate accounts that violate these rules, with or without prior notice, at our sole discretion.

5. Content and Intellectual Property

Your content: You retain ownership of all photographs and content you upload. By uploading content, you grant Eventiere a limited, non-exclusive, royalty-free licence to store, process and display the content solely for the purpose of providing the Services to you and your guests.

Our platform: The Eventiere platform, including its software, algorithms, design and branding, is owned by or licensed to Eventiere. Nothing in these Terms transfers any intellectual property rights to you.

Guest photographs: Guests who receive photos via Eventiere retain personal use rights to their own photographs. Commercial use of event photographs requires separate agreement with the event organiser and/or photographer.

6. Privacy and Data Protection

Our collection and use of personal data, including biometric data, is governed by our Privacy Policy, which forms part of these Terms. Organisers act as independent data controllers for the personal data of their event guests. Eventiere acts as a data processor on behalf of organisers for the purposes of facial matching and photo delivery.

Organisers must have a valid data processing agreement in place with Eventiere before processing personal data of EU or UK residents. This agreement is incorporated into your subscription upon acceptance of these Terms.

7. Subscription, Fees and Payment

Eventiere offers paid subscription plans as described on our Pricing page. By subscribing, you authorise us to charge your payment method on the billing cycle you select.

• Refunds: Subscription fees are non-refundable except where required by applicable law or as stated in your order confirmation.
• Upgrades/downgrades: Plan changes take effect at the start of the next billing cycle unless otherwise agreed.
• Late payment: Accounts with overdue payments may be suspended until the balance is cleared.
• Taxes: Fees are exclusive of applicable taxes (VAT, GST, etc.), which will be added at checkout where required.

8. Service Availability and SLA

We target 99.9% monthly uptime for the core API and guest portal. Planned maintenance will be announced via our status page with reasonable advance notice. We are not liable for downtime caused by factors outside our control (force majeure, third-party infrastructure failures, etc.).

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• Eventiere's total liability for any claim arising from these Terms or use of the Services will not exceed the fees paid by you in the 12 months preceding the claim.
• We are not liable for indirect, consequential, incidental, or punitive damages, including loss of revenue, data loss, or reputational harm.
• We do not warrant that the Services will be error-free, that AI photo matching will achieve any specific accuracy rate for every guest, or that all photos will be successfully matched.

10. Indemnification

You agree to indemnify and hold harmless Eventiere, its officers, employees and agents from any claims, losses, or expenses (including legal fees) arising from: (a) your use of the Services in violation of these Terms; (b) your failure to obtain required consents from event guests; or (c) your infringement of any third party's rights through content you upload.

11. Termination

Either party may terminate a subscription at any time. Upon termination:

• Your access to the organiser portal will end at the close of your current billing period.
• Event gallery links will remain accessible to guests for 30 days post-termination unless you request earlier deletion.
• We will delete organiser account data within 90 days of termination, subject to legal retention obligations.

12. Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. For organisers based in the UAE or Qatar, disputes may alternatively be resolved under the jurisdiction agreed in your order form or enterprise agreement.

Any disputes not resolved by mutual agreement will be subject to the exclusive jurisdiction of the courts of England and Wales, unless agreed otherwise in writing.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email to registered organisers at least 30 days before they take effect. Continued use of the Services after that date constitutes acceptance of the revised Terms.
